Covenants Variance for Roofing The following position on roofing materials was established in Mountain Shadows by the Schuck Corporation when they were the approving authority (AA). Since the covenants were not amended and Schuck relinquished their AA status and responsibility as of January 28, 2002, this variance does not officially carry over in the covenants to the new AA. However, the MSCA Board of Directors feels that this is a reasonable variance to follow in the absence of an AA and for AAs established since January 28, 2002. We encourage new AAs to add to this list as new roofing materials become available that meet the stated criteria. New Home Construction: The approving Authority will permit the use of certain composition roofing materials for new homes, and sample boards are available for inspection at the Mountain Shadows Sales & Information Center. Acceptable materials are based upon the following criteria: · Roofing must meet a Class A fire rating. · Roofing must have a 40-year warranty. · Roofing materials permitted at this time will be limited to the following: Celotex “Presidential Shake” Elk Premium Roofing “Prestique Plus High Definition” Owens Corning “Oakridge Shadow” Colors to be reviewed and approved on a case-by-case basis. Re-roofing: The Approving Authority will permit the use of the above listed roofing materials for existing homeowners wishing to install new roofs on their homes. It is the desire of the Approving Authority to limit colors to those that blend in most effectively with the surrounding residences. For example, in neighborhoods with predominantly wood shake roofing, the composition roofing color should blend with weathered wood shakes. Additional Composition Roofing Materials: The Mountain Shadows Approving Authority will review additional materials from time to time, but such roofing materials will be required to meet the above criteria for acceptance. Samples must be submitted prior to acceptance, along with locations of residences having such composition roofing so that the Approving Authority can make an adequate determination.
